Apple’s ‘Trademark’ Silhouettes

Pursuing the Apple vs. Lugz ad controversy even deeper, I came across this hissy fit that Apple threw about Fuse TV parodying the style of the iPod ads for their own campaign. [Better pics from Gizmodo here] Obviously Fuse did it to make fun of the ads, so they were fully aware of the similarities. Yet Azriel and I agree that a style of design is often more a tool, not a unique artistic expression. And the Gizmodo article seems to confirm this, citing that the iPod ads look strikingly similar to a campaign Toronto's Flow 93.5 FM ran years before them. It's hard to create design that doesn't in some fashion incorporate styles that haven't already been created, tweaked, re-used, revised and re-discovered before! Just look at all the commercials using the '3D text' style. I don't see any lawsuits about that. Hopefully my iDie parody won't get me in trouble! It's, uhhhh, artistic expression!
